Final Plan of Subdivision-220 Fairview Avenue

MOTION BY DEBBIE GENTILE TO GRANT THE FOLLOWING WAIVERS FOR THE SUBDIVISION OF THE PROPERTY KNOWN AS TAX PARCEL 32-003-193 AS SHOWN ON A PLAN TITLED FINAL PLAN OF SUBDIVISION FOR 220 FAIRVIEW AVENUE MADE FOR GUY AND MARIE SEROTA PERPARED BY EASTERN/CHADROW ASSOCIATES, INC. DATED DECEMBER 14, 2010 AND REVISED OCTOBER 12, 2012 CONSISTING OF FOUR PLAN SHEETS, AND ALSO INCLUDING A POST CONSTRUCTION STORMWATER MANAGEMENT AND EROSION AND SEDIMENTATION CONTROL REPORT PREPARED BY EASTERN/CHADROW ASSOCIATES, INC. DATED OCTOBER 12, 2012: 

 Applicant shall comply with recommendations of the Borough Engineer as set forth in a letter dated November 28, 1012 with the exception of comments numbered 5 and 11a.

  1. The applicant was granted a waiver from Ordinance Section 355-18.E requiring financial guarantee for completion of all improvements, with an understanding that escrow may instead be posted for improvements to completion of each lot, conditioned upon an reaching an agreement satisfactory to the Borough Solicitor. 
  2. The applicant was granted a waiver from Ordinance Section 355-32.G(1)(b).
  3. The applicant shall replace existing trees along the street frontage if they must be removed as a result of damage or disease prior to the completion of construction activities.
  4. The applicant was granted a waiver from Ordinance Sections 345-18(B)(3) and 345-28.C(1)(i) and 345-31 conditioned upon a note being added to the plan providing a blanket easement for the Borough to access stormwater management facilities.  The language of the note must be acceptable to the Borough Solicitor.
  1. As recommended by the Borough Planning Commission, the applicant shall add a note to the plan stating “Integrity of the existing laterals on lots 1 and 2 must be video inspected and confirmed concurrent with construction activities.  Video images will be provided to the borough.  Any deficiencies shall be repaired to the satisfaction of the Borough Engineer”
  1. Applicant shall comply with the recommendations of the Bucks County Planning Commission in its memo dated November 27, 2012.
  2. Applicant shall comply in full with all requirements of all Penndel Borough Ordinances and regulations including but not limited to the Penndel Borough Subdivision and Land Development Ordinance and Penndel Zoning Ordinance, unless Borough Council has granted specific waivers with respect to the Subdivision and Land Development Ordinance or the Zoning Hearing Board has granted variances with respect to the Zoning Ordinance.
  3. Applicant shall comply with all federal, state and local regulations including but not limited to those imposed by the Bucks County Conservation District, Bucks County Department of Health, the Pennsylvania Department of Environmental Protection, Pennsylvania Department of Transportation and the Bucks County Water and Sewer Authority with regard to the proposed subdivision and development.
  4. Applicant shall apply for and receive all appropriate permits prior to the commencement of construction and/or renovations of the building and improvements.

Streets

Demolition of Park Avenue started today between Bellevue Avenue and Lincoln Avenue.  The job should be completed in two months.  A change order may be needed on the wearing course depending on weather conditions.

 Sewer

The owner of 448 W. Lincoln was informed of the large flow coming from his lateral.  He  has until January 20th to have it televised. 

Community  Development

The Agreement of Sale on the Evans property has been signed. 

 Finance

MOTION BY BARBARA HEFFELFINGER TO PAY THE UNEMPLOYMENT COMPENSATION SOLVENCY FEE FOR 2013 FOR $484.32.  SECONDED BY DEBBIE GENTILE.  All yes, carried.

 Pension/Insurance

MOTION BY SUE ANDERSON TO APPROVE JEFF HUGO WITH InR TO TRANSFER PENSION FUNDS FROM CHARLES SCHWAB TO TD AMERITRADE.  SECONDED BY BARBARA HEFFELFINGER.  All ayes, carried.

MOTION BY SUE ANDERSON TO ADJOURN THE MEETING.  SECONDED BY DEBBIE GENTILE.
