COUNCIL MEETING

 December 3, 2012

Attendees:  Sean Weckerly, President; Sue Anderson, Vice President; Arlene Harms, Barbara Heffelfinger, John Lo Piccolo and Bob Miller, Borough Council; Mayor Bob Winkler and Don Williams, Solicitor.  Debbie Gentile was away.

Presentations by Chief Sciscio

Chief Sciscio presented an award to State Representative Frank Farry for his assistance to Penndel Police this year apprehending a suspect.  He presented an award to Kevin Diabelko from Bradley Funeral Home for his contributions and support of the department.

He also presented the following officers with commendations for outstanding service: Jesse Spencer, Raymond Longhitano, Kathleen Bevans, Sean Perry, Sean Dimeo and Tim King.

Presentations by Mayor Winkler

The Mayor presented a letter of appreciation to Bob King for his volunteer services with Christmas decorations and building preparation.  A letter of appreciation went to Tim and Tyler Turner, and Anthony Winkler for their volunteer assistance clearing borough streets during Hurricane Sandy.

 The Mayor also presented a Certificate of Appreciation to the Diabelko Family for their contribution to the Penndel Memorial and many contributions to the Borough of Penndel and the police department.

The very first Mayor’s Crime Prevention Award was presented to Wendy Kavurmas for her contributions by being proactive and improving security at Mill Creek Village Apartments and her assistance to the police department with crime prevention and her excellent community relations.

Vacation of alley on Mongillo property 32-004-003

MOTION BY SUE ANDERSON TO ADOPT ORDINANCE #2012-8 VACATING AND RELINQUISHING PENNDEL BOROUGH’S RIGHT, TITLE AND INTEREST IN AN AREA LOCATED ON BUCKS COUNTY TAX MAP PARCEL NUMBER 32-004-003.  SECONDED BY ARLENE HARMS.  All ayes, carried.

MOTION BY BARBARA HEFFELFINGER TO APPROVE THE MINUTES OF THE NOVEMBER 5, 2012 COUNCIL MEETING, THE NOVEMBER 13, 2012 AND NOVEMBER 26, 2012 WORK SESSIONS.  SECONDED BY ARLENE HARMS.  (Sue Anderson abstained from voting on the 11/5/12 meeting, Bob Miller abstained on the 11/20/12 meeting due to absence)  All ayes, carried.

Mayor’s Report – Mayor Winkler read his report, which is attached.

Chief’s Report – Chief Sciscio read his report, which is on file in the secretary’s office.

Code Enforcement Report – Gianpiero Lo Piccolo read the report, which is on file in the secretary’s office.

 Solicitor’s Report

For the Month of November 2012:

-Consulted with Borough Secretary, Council President, Mayor and borough engineers regarding various borough matters and agenda items

-Assisted the Right to Know Officer with Right to Know Issues

 -Attended a Planning Commission meeting

-Attended a Meeting with the Mayor regarding police matters

 – Reviewed documents and discussed settlement with the Middletown Solicitor regarding the Evans tract acquisition

-Reviewed various project documents regarding the Park Ave. project

Committee Reports

Building and Maintenance (Arlene Harms):

The new work station was installed this month.  The donated counter and cabinets were very much appreciated.

Recreation Board (Arlene Harms):

There was no meeting this month due to lack of a quorum.  Mrs. Harms thanked the Mayor and Council for cleaning up the tree on the property.

Long Range Finance (Lo Piccolo):

Mr. Lo Piccolo will be organizing the committee next year.  He attended the Bucks County Water and Sewer Authority customer appreciation dinner.  He was glad to meet representatives from other towns.

 Community Development (Heffelfinger):

The reconstruction of Park Avenue project will be starting next week.  She attended the pre-construction meeting held on November 26th.  The road closing signs will be posted this week in four directions.  The project is being funded by the state Bucks County Beautification Grant.  Meetings on the TCDI Reconstruction of the recreation field intersection and Taddei Woods project will be after the new year.

 Mrs. Heffelfinger thanked Representative Farry for his help in obtaining the $125,000 grant for the recreation field.  The match can be paid with in-kind services. 

 Settlement on the purchase of Spring Valley Farm with Middletown Township will be in the near future. 

 Pension/Insurance (Anderson):

Attended quarterly meeting with InR.  Funds have increased over 4%.

 MOTION BY SUE ANDERSON TO AMEND THE BENEFIT SCHEDULE TO PROVIDE HEALTH, DENTAL, AND VISION BENEFITS AND COVERAGES FOR CLASS ONE EMPLOYEES.  SECONDED BY ARLENE HARMS.  All ayes, carried.

 Sewer (Miller):

The sewer system endured Hurricane Sandy storm with no complications. 

Reading and approval of bills

MOTION BY BARBARA HEFFELFINGER TO PAY THE FOLLOWING BILLS FOR THE MONTH OF NOVEMBER 2012:

General Fund bills in the amount of $46,945.87

Liquid Fuel Fund bills in the amount of $290.00

MOTION BY BARBARA HEFFELFINGER TO ADOPT THE 2013 BUDGET IN THE AMOUNT OF:                              $2,251,762.00 – This includes:

                        $   760,963.00 for General Fund

                        $     76,079.00 for Highway Aid

                        $     26,600.00 for Fire Tax

                        $   305,805.00 for Other Governmental Funds

                        $1,082,315.00 for Proprietary Funds

SECONDED BY ARLENE HARMS.  The vote was 5 ayes, 1 no (Gianpiero Lo Piccolo).  The ayes, carried. 

 Council President, Sean Weckerly read his budget message, which is attached.

MOTION BY BARBARA HEFFELFINGER TO ADOPT ORDINANCE #2012-9 ESTABLISHING A TAX FOR FISCAL YEAR 2013 IN THE AMOUNT OF 18.5 MILLS FOR GENERAL BOROUGH PURPOSES AND 1.5 FOR FIRE TAX.  SECONDED BY ARLENE HARMS.  The vote was 5 ayes, 1 no (Gianpiero Lo Piccolo).  The ayes, carried.

MOTION BY BARBARA HEFFELFINGER TO ADVERTISE THE 2013 MEETING SCHEDULE WITH THE CORRECTION OF THE TIME OF WORK SESSIONS TO BE 7:30 P.M. NOT 7:00 P.M.  SECONDED BY SUE ANDERSON.  All ayes, carried

 MOTION BY SUE ANDERSON TO ADOPT RESOLUTION #2012-11 ACKNOWLEDGING THE RIGHTS OF EMPLOYEES TO RECEIVE BENEFITS UNDER THE FAMILY MEDICAL LEAVE ACT.  SECONDED BY ARLENE HARMS.  All ayes, carried.

MOTION BY BARBARA HEFFELFINGER TO AUTHORIZE ADVERTISEMENT OF AN ORDINANCE APPROVING THE INTERGOVERNMENTAL COOPERATION AGREEMENT WITH MIDDLETOWN TOWNSHIP FOR THE PURCHASE OF MIDDLETOWN SPRING VALLEY FARM.  SECONDED BY ARLENE HARMS.  All ayes, carried. 

 MOTION BY BARBARA HEFFELFINGER TO AUTHORIZE ADVERTISEMENT OF AN ORDINANCE APPROVING PAYMENT OF THE $25,000. MATCH AND ALL NECESSARY SETTLEMENT EXPENSES FOR THE PURCHASE OF MIDDLETOWN SPRING VALLEY FARM.  SECONDED BY ARLENE HARMS.  All ayes, carried.

 Public Comment

Karen Kondrk, 426 Fairview Avenue, announced there will be a postal service food drive on Saturday 12/8

 Arlene Harms thanked Sean Weckerly for doing a wonderful job as Council President this past year.
